We at Rad Camp, Inc. (“RAD Camp”, “RAD”, “RAD Club”, “we”, “us”, or “our”) created this privacy policy (“Privacy Policy”) because we know that you (“You”, “User”, “Authorized User”) care about how information you provide to us is used and shared Protecting your private information is our priority. This Statement of Privacy applies to RAD Camp, Inc in connection with our online services (the “Services”), which are made available to you though our Website located at www.RADCamp.org  and our affiliated sites, such as those used for Rad Club (the “Website” or “Site”), and governs data collection and usage. The RAD Website is an information and membership site. 

We strive to educate parents and kids about how to appropriately safeguard their privacy when using our Services. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access and/or use our Services. We urge kids to check with their parents before entering information through our Site and/or Services, and we recommend that parents discuss with their kids restrictions regarding the online release of Personal Information (as defined below) to anyone they don’t know.

By visiting our Site and/or using our Services, or by permitting your child to use our Services, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

COLLECTION OF YOUR PERSONAL INFORMATION

In order to better provide you with products and services offered on our site, RAD may collect personally identifiable information, such as your: 

  • First and Last Name
  • Mailing Address
  • E-mail address
  • Phone number

If you purchase RAD products or services, we collect billing and credit card information. This information is used to complete the purchase transaction. 

RAD may also collect anonymous demographic information which is not unique to you.

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the site. These may include: (a) registering for an account on our site; (b) entering a sweepstakes or contest sponsored by us or one for our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services on our site, we refer to such information as “Personal Information”. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future. 

Other than the online contact information required to obtain parental consent, we do not collect any Personal Information from Users under the age of 13 unless the User’s parent or legal guardian has first provided us with consent for that User to use the Services and disclose Personal Information to us. If you are a User under the age of 13, please do not send any Personal Information to us if we have not obtained prior consent from your parent or guardian. If we learn we have collected Personal Information from a User under the age of 13 without parental consent, or if we learn a User under the age of 13 has provided us Personal Information beyond what we request from him or her, we will delete that information as quickly as possible. USE OF YOUR PERSONAL INFORMATION

RAD collects and uses your personal information to operate its Website(s) and deliver the services you have requested. 

RAD may also use your personally identifiable information to inform you of other products or services available from RAD and its affiliates.

RAD may also use your personally identifiable information to apply for various grants, scholarships, or other forms of funding that require RAD to disclose information related to its members, donors, volunteers, etc. When your personally identifiable information is required to be used for this purpose, RAD will take reasonable measures to limit the information shared when possible. 

Like most websites, we use automatic data collection technology when you visit the Site to record information that identifies your computer, to track your use of our Site, and to collect certain basic information about you and your surfing habits. This information includes information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site and the Services (the “Usage Information”).

We collect this Usage Information by using cookies and pixel tags (also called web beacons or clear gifs). Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of website users. You can reject cookies by following the directions provided in your Internet provider’s “help” file. If you reject cookies, you may still visit the Site, but may not be able to use some areas of the Site and/or the Services.

We do not collect Personal Information in this way, but if you’ve provided us with Personal Information, we may associate that information with the information that is collected automatically. Automatic data collection may be performed on our behalf by our services providers.

HOW WE USE YOUR INFORMATION

We may use your Personal Information and Usage Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you. We will use your Personal Information and Usage Information collected through the Site for the following purposes:

  • To identify you when you sign in to your account;
  • To respond to your requests and to provide you with the Services;
  • To respond to your inquiries and contact you about changes to the Site and/or the Services;
  • To send you notices (for example, in the form of e-mails, mailings, and the like) regarding products or services you are receiving, and for billing and collection purposes;

SHARING INFORMATION WITH THIRD PARTIES 

RAD does not sell, rent or lease its customer lists to third parties. 

RAD may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to RAD, and they are required to maintain the confidentiality of your information. 

RAD may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on RAD or the site; (b) protect and defend the rights or property of RAD; and/or (c) act under exigent circumstances to protect the personal safety of users of RAD, or the public. 

If RAD or all or substantially all of RAD’s assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets.

TRACKING USER BEHAVIOR

RAD may keep track of the Website and pages our users visit within RAD, in order to determine what RAD services are the most popular. This data is used to deliver customized content and advertising within RAD to customers whose behavior indicates that they are interested in a particular subject area. 

AUTOMATICALLY COLLECTED INFORMATION 

Information about your computer hardware and software may be automatically collected by RAD. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the services, to maintain quality of the service, and to provide general statistics regarding use of the RAD Website.

The RAD Website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. SECURITY OF YOUR PERSONAL INFORMATION

RAD secures your personal information from unauthorized access, use, or disclosure. RAD uses the following methods for this purpose: SSL PROTOCOL.

When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL protocol.) 

We take commercially reasonable steps to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we stive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed. In particular, e-mails, links, video messaging or live display technologies that we provide to you directly or which you access from the Website (including but not limited to Zoom, Facebook Live, Instagram Live, Microsoft Teams, Google Hangouts, etc.) may not be secure, and you should therefore take special care in deciding what information you send to us and share with us at all times.

RIGHT TO DELETION

Subject to certain exceptions set out below on receipt of a verifiable request from you, we will: 

  • Delete your personal information from our records; and
  • Direct any services providers to delete your personal information form their records

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided by for law
  • Comply with the California Electronic Communications Privacy Act; 
  • Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research provided we have obtained your informed consent; 
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 
  • Comply with an existing legal obligation; or 
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information 

CHILDREN UNDER THIRTEEN

As noted previously in this Privacy Policy, RAD does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this Website. 

E-MAIL COMMUNICATIONS

From time to time, RAD may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from RAD or click on a link therein. 

If you would like to stop receiving marketing or promotional communications via email from RAD, you may opt out of such communications by clicking the unsubscribe link at the end of each email correspondence. You can also send an unsubscribe request to camp@radcamp.org.

SHINE THE LIGHT LAW

Under California Civil Code Section 1798.83, California residents who have an established business relationship with us may choose to opt out of our sharing their contact information with third parties for direct marketing purposes. If you are a California resident and you wish to opt out, please send an e-mail to camp@radcamp.org and specify your request to opt out.

DO NOT TRACK

We do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

CALIFORNIA CONSUMER PRIVACY ACT – CALIFORNIA USERS

California User Rights. You have the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to exercise free of charge:

The Website and the Services are operated in the United States. If you are located outside of the

United States, please be aware that any information you provide to us will be transferred to the United States. By providing us with any information through the Site or the Services, you consent to this transfer. This Site is not intended to comply with GDPR or it’s requirements and you should not use the Website if you wish to enforce the GDPR laws against RAD.

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. RAD reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page. Your continued use of the site and/or services available through the site after such modifications will constitute your: (a) acknowledgement of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
